WE'LL GO AHEAD AND START WITH THE DEVELOPMENT ITEMS WITH PUBLIC HEARINGS. IT WILL BE OUR FIRST ITEM ON THE AGENDA, IS BEAR RANS REQUEST FOR RODDY'S SUBDIVISION NUMBER 3, RESUBDIVISION NUMBER 2. STAFF, COULD YOU GIVE ME THE

REPORT? >> GOOD EVENING, COMMISSIONER.

OUR ITEM IS OF VICTIMTORIA CAR WASH SERVICES LLC, THE CHOPPING BLOCK VICTORIA LLC AND COUPEIS CORPUS CHRISTY ARE THE ENGINEERING OWNERS. THE SUBJECT PROPERTY IS LOCATED AT 7010 AND 70102 NORTH NAVARRO STREET AND DESCRIBED AS LOT 1R AND BLOCK 2R, BLOCK 1 OF RESUBDIVISION NUMBER 1, RECORDED IN VOLUME 9 PAGE 33C AND D OF THE CITY OF VICTIMTORIA, VICTORIA COUNTY, TEXAS. SO THE SUBJECT PROPERTY CURRENTLY EXISTS IS TWO GENERAL COMMERCIAL LOTS WITHIN A PLOTTED SUBDIVISION. THE PROPERTY OWNERS WISH TO SUBDIVIDE THE LOT FROM THE EXISTING LUBE SHOP MOBILE LUBE EXPRESS. THE SUBDIVISION WILL REQUIRE THE OWNERS TO REPLAT THE PROPERTY. THE OWNERS ARE PROPOSING TO CREATE THREE GENERAL COMMERCIAL LOTS WITH ONE OF THE LOTS NOT NEEDING THE MINIMUM LOT WITH REQUIREMENT.

THE OWNERS ARE REQUESTING A VARIANCE IN ORDER TO REPLOT THE COMPANY. VICTORIA CODE OF ORDINANCE REQUIRES GENERAL COMMERCIAL THROTS HAVE A MINIMUM LOT WITH OVER 100 FEET. THE PROPOSED LOT 1RB WILL HAVE A LOT WITH APPROXIMATELY 32 FEET BEING BELOW THE MINIMUM LOT THAT'S REQUIRED FOR GENERAL COMMERCIAL LOTS.

THE PROPOSED LOT 1RA AND LOT 2RA WILL BOTH MEET THE MINIMUM LOT WIDTH REQUIREMENTS. LOT 1RB WILL BE ABLE TO ADHERE TO ALL DEVELOPMENT GUIDELINES REQUIRED OF GENERAL COMMERCIAL LOTS DESPITE HAVING A LOT WITH BELOW MINIMUM LOT WITH REQUIRED.

NUMBER 3 AND RESUBDIVISION NUMBER 2 IS A PROPOSED FINAL PLAT OF 2.A 5 ACRES BEING PLATTED IN THE GENERAL COMMERCIAL BLOCKS WITHIN BLOCKS 1, 1RA, 1RB AND 2RA.

ACCESS TO THE SUBDIVISION AND LOTS WILL BE FROM NORTH NAVARRO STREET AND EXISTING THOROUGHFARE AND DERRY ROAD AND EXISTING LOCAL STREET. THE FINAL PLAT WILL MEET ALL APPLICABLE ORDINANCES WITH APPROVAL OF THE VARIANCE.

STAFF DOES RECOMMEND APPROVAL OF THE VARIANCE REQUEST TO ALOFT THE PLATTING OF THREE GENERAL COMMERCIAL LOTS.

THE SLEARNS ALLOW THE LOT WITH LOT 1RB TO BE BELOW THE MINIMUM LOT WITH REQUIREMENT WHILE MEETING ALL OTHER GENERAL COMMERCIAL LOT REQUIREMENTS SET OUT IN CITY CODE.

THE PROPERTY HAS BEEN DEVELOPED AND EXISTED IN ITS CURRENT CONFIGURATION FOR YEARS. STAFF HAS DETERMINED THE APPROVAL OF A VARIANCE BUT NOT CHANGED THE EXISTING CHARACTER OF THE NEIGHBORHOOD AND NOT BE DETRIMENTAL TO SURROUNDING LOTS.

FURTHERMORE OUR ANALYSIS SUGGEST THAT ALLOWING THE REDUCTION OF THE MINIMUM LOT WIDTH WOULD NOT BE DETRIMENTAL TO THE HEALTH, SAFETY OR WELFARE OF THE SURROUNDING NEIGHBORHOOD.

FURTHERMORE SHARED ACCESS AGREEMENT HAS BEEN EXECUTED BETWEEN THE PROPERTY OWNERS TO ALLOW CONTINUED USE OF THE DRIVEWAYS ON NORTH NAVARRO STREET AND DERRY ROAD FOR LOTS 1RA AND 1RB. SHARED ACCESS BETWEEN THE LOTS WILL CONTINUE THE FLOW OF TRAFFIC AND THE TRAFFIC PATTERN WILL REMAIN AS IS. STAFF ALSO RECOMMENDS APPROVAL OF THE FINAL PLAT OF RODDY SUBDIVISION NUMBER 3, RESUBDIVISION NUMBER 2 CONDITIONED PONT FINAL APPROVAL THE REQUESTED VARIANCE BY CITY COUNCIL.

>> IT'S BASICALLY A LEGAL DOCUMENT THAT SAYS, YOU KNOW, THAT THERE HAS TO BE SHARED ACCESS, THAT PROPERTY ACCESSING LOT 1 -- VEHICLES ACCESSING LOT 1 CAN CROSS LOT 2 TO ACCESS, AND THEN THERE'S ALSO SHARED PARKING.

AND SO BECAUSE THAT'S A LEGAL DOCUMENT FILED DOWN AT COURTHOUSE AND IT'S TODAY TO THIS CONDITION, THE CITY IN THAT DOCUMENT, IT ESSENTIALLY ALLOWS THEM TO BREAK UP THE PLAT BY DIFFERENT OWNERSHIP BUT FUNCTIONALLY NOTHING CHANGES BECAUSE EACH LOT HAS RIGHTS TO CROSS THE OTHER LOT FOR THAT VEHICULAR ACCESS AND FUNCTION. SO THE FUNCTIONALITY AND WHAT PEOPLE WOULD KNOW, THAT ALL STAYS THE SAME.

IT'S JUST THE LEGAL TYPE THAT THEN CAN BE CHANGED BECAUSE THEY'RE DIFFERENT LOTS, AND SO PARCEL 1 COULD BE SOLD AND PARCEL B. AND YOU SEE A LOT OF THEM IN OUR CONDITIONS IS BECAUSE WHEN DO YOU HAVE THOSE LEGAL DOCUMENTS WITH SHARED ACCESS OR PARKING AGREEMENTS, IT CREATES THAT SAME FUNCTION AS THINGS CURRENTLY EXIST, AND JUST KIND OF ALLOWS, YOU KNOW, DIFFERENTLY THE OWNERSHIP TO TAKE PLACE.

I'M SORRY. >> SO WITHIN THE MONTH OF APRIL 2023, THE CITY OF VICTIMTORIA ISSUED 137 PERMITS AS WELL AS 133 OVERALL COMBINED MEP PERMITS, WE ALSO COLLECTED APPROXIMATELY $44,400 IN PERMIT FEES WITHIN THE MONTH OF APRIL 2023. WITHIN THE MONTH OF APRIL 2022 THE CITY ISSUED 157 PERMITS AS WELL AS A TOTAL OF 210 OVERALL COMBINED MEP PERMITS. THE CITY OF VICTIMTORIA COLLECTED APPROXIMATELY $56,000 IN APRIL OF 2022.

THINGS THAT WE HAD ON WEDNESDAY HOW DID THAT GO?

>> I THINK IT ACTUALLY WENT VERY WELL.

THE ATTENDANCE WAS MEDIOCRE BUT THES YOU INPUT WE RECEIVED WAS VERY HIGH QUALITY. THOSE THAT DID ATTEND WERE VERY INTERESTED. WE HAD A LOT OF BICYCLISTS AND PEOPLE ACTUALLY USING THE RIVERSIDE TRAIL NETWORK AND PEOPLE VERY INTERESTED IN ACTIVE TRANSPORTATION MASTER PLAN AND SO THE INPUT WE RECEIVED IS VERY QUALITY.

SO EVEN THOUGH, YOU KNOW, WE HAD LESS THAN TWO DOZEN FOLKS ATTEND THE DIFFERENT MEETINGS, WE ARE STILL VERY HAPPY WITH INPUT BECAUSE IT WAS VERY ROBUST, VERY GOOD.

EACH STAKEHOLDER GROUP TOOK THE ENTIRE TIME TO WORK ON THE MAPS AND GIVE US A LOT OF INFORMATION.

IT WAS WORTHWHILE AND OF COURSE IF YOU WANT TO STILL GIVE INPUT WE DO HAVE THE SURVEY THAT'S GOING TO STAY OPEN UNTIL JUNE 5TH. YOU CAN GO TO THE MASTER PLAN'S WEBPAGE ON THE CITY'S WEBSITE TO THE SPECIFIC PAGE AND LINK TO THE SURVEYS IF YOU ARE A WALKER OR BICYCLIST IN TOWN.
