THE FIRST ITEM ON THE AGENDA TODAY IS A VARIANCE REQUEST FOR SUBDIVISION NUMBER 10. ROGERS RODRIGUEZ IS THE OWNER.

THE SUBJECT PROPERTY OWNER IS LOCATED AT 104 E. BRAZOS STREET IN TEXAS AND IS DESCRIBED AS A 0.196 ACRE TRACT OF LAND IN A PORTION OF ONE LOT AND LOT FOR AS RECORDED IN VOLUME 1 PAGE 29 IN VICTORIA COUNTY TEXAS. THE PROPERTY OWNER WOULD WISH TO DEMOLISH THE EXISTING STRUCTURE AND BUILD A NEW STRUCTURE IN ITS PLACE ON THEIR LOT.

THE OWNER HAS BEEN GIVEN A CONDITIONAL OFFER US THE FUNDED RECONSTRUCTION ON THEIR PROPERTY.

THE OWNER IS REQUESTING A VARIANCE TO SECTION 21 ? 8282 OF THE VICTORIA CODE OF ORDINANCES WHICH REQUIRE SINGLE-FAMILY RESIDENTIAL LOTS TO HAVE A MINIMUM LOT WITH 50 FEET. THE VARIANCE WILL ALLOW FOR THE PROPOSED LOT FOR A TO BE CREATED WITHIN A LOT OF 46 FEET WHILE MEETING THE OTHER REQUIREMENTS SET OUT IN THE CITY CODE FOR SINGLE-FAMILY RESIDENTIAL LOTS.

RESUBDIVISION NUMBER 10 IS A PROPOSED FINAL PLAT OF 0.169 ACRES. ACCESS TO THE SUBDIVISION AND LOT WILL BE FROM EAST BRAZOS STREET.HE FINAL PLOT WILL MEET THE APPLICABLE ORDINANCES WITH APPROVAL OF THE VARIANCE.

THERE IS A WATER SERVICE MEETING BEING PROVIDED BY AN EXISTING 8 INCH WATERS LINES AS WELL AS SEWER BEING PROVIDED IN EAST BRAZOS STREET.F YOU TAKE A LOOK AT THE PLANT WE DID DEDICATE A 5 FOOT UTILITY EASEMENT TO THE FRONT FOR THOSE UTILITIES. STAFF DOES RECOMMEND APPROVAL OF THE VARIANCE REQUEST TO ALLOW THE PLATTING OF ONE SINGLE-FAMILY RESIDENTIAL LOTS. THIS WILL ALLOW THE LOT WITHIN THE MINIMUM REQUIREMENT. STAFF HAS DETERMINED THE APPROVAL OF THE VARIANCE WILL NOT SIGNIFICANTLY CHANGE THE EXISTING CHARACTER OF THE NEIGHBORHOOD AND WILL NOT BE DETRIMENTAL TO THE SURROUNDING LOTS.

THE CITY OF VICTORIA HAS AN INTEREST IN NOT ONLY COOPERATING WITH OTHER SUBDIVISION OF GOVERNMENT BUT ALSO ALLOWING RESOURCES TO BE DISTRIBUTED TO THE CITIZENS WHO NEED THEM. STAFF RECOMMENDS APPROVAL OF THE FINAL PLOT SUBDIVISION NUMBER 10 CONDITIONED UPON THE FINAL APPROVAL OF THE REQUESTED VARIANCE BY CITY COUNCIL.

AT THIS TIME STAFF IS IN SUPPORT OF THE VARIANCE TO GO AHEAD AND WAIVE THAT DEDICATION AND ALLOW THE CERTIFICATE OF OWNERSHIP TO REMOVE THAT LANGUAGE OF THAT DEDICATION. ANY OTHER QUESTIONS?

THE TMP PROVIDES AN ANALYSIS OF THE EXISTING ROADWAY CONDITIONS, FUTURE DEVELOPMENT PLOT PATTERNS, TRAVEL NEEDS AND EXISTING POLICIES AND PROCEDURES AND BEST PRACTICES IN COMMUNITY GOALS.

THE CITY OF VICTORIA CITY COUNCIL ADOPTED THE CURRENT FAIR MASTER PLAN IN JUNE 2021. BECAUSE OF THE RECENT DEVELOPMENT INTERESTS AND PROPOSE SECONDARY ARTERIALS EXTENSION NEEDS TO BE REMOVED FROM THE PLAN AS IT IS IS NOT BENEFICIAL TO THE DEVELOPMENT AND RESTRICTS FURTHER DEVELOPMENT BECAUSE OF THE PROPOSED EXTENSION.

THE REMOVAL IS CURRENTLY DESIGNATED TO LINE UP WITH THE EXISTING NORTH SIDE ROAD THAT RUNS NORTHWEST OFF OF HIGHWAY 177 NORTH THE CROSSING OF HIGHWAY 77 NORTH DOES NOT MEET ENGINEERING STANDARDS THAT REQUIRE INTERSECTIONS TO BE AT A 90? ANGLE. AFTER FURTHER REVIEW STAFF BELIEVES IT IS UNNECESSARY JUST BECAUSE OF THE PROXIMITY TO OTHER EXISTING AND PLANNED AREAS SUCH AS THE PLANNED EXPANSION OF THE AIRPORT ROAD AND THE EXISTING CORRIDOR.

STOP IS PROPOSING THAT THE COMMISSIONERS RENT APPROVE THE REMOVAL BETWEEN HIGHWAY 77 NORTH AND SALEM ROAD.
