THE ITEM ON THE AGENDA IS VARIANCE REQUEST FOR HENSON COLE LLC. THE SUBJECT PROPERTY IS LOCATED AT 2407 NORTH NAVARRO AND HAS DEVELOPED AND EXISTED AS A COMMERCIAL LOT. THE PROPERTY OWNER WANTS TO EXPAND THE STRUCTURE. THE PROPERTY WAS REQUIRED TO PREP THE PROPERTY AND REQUIRED TO PRESENT A SITE PLAN AND BUILDING PLANS. SETBACK APPROXIMATELY 13 FEET.

THE OWNER IS REQUESTING A VAIANS TO ALLOW THE MIDDLE OF THE SITE PLAN AND APPROVAL PLANS FOR THE EXPANSION OF THE EXISTING STRUCTURE, TO ENCROACH 13 FEET IN THE ESTABLISHED YEAR YARD SETBACK. THE EXISTING STRUCTURE CONFORMS TO THE REAR YARD SETBACK, ESTABLISHED BY HENSON COLE LLC.

THE PROPOSED EXPANSION WOULD BE IN LINE WITH THE EXISTING STRUCTURES AT THE REAR OF THE PROPERTY.

THE EXPANSION WOULD BE IN LINE WLT PREEXISTING SETBACK BEFORE THE PROPERTY WAS REQUIRED TO BE PLATTED.

STAFF RECOMMENDS APPROVAL OF THE REQUEST TO ALLOW THE SUBMITTAL AND SUBSEQUENT BUILDING PLANS DEPICTING THE EXISTING STRUCTURE, ENCROACHING INTO THE 13 FEET, 25 FEET REAR BACK SETBACK. AND FURTHERMORE, THE EXPANSION WOULD NEED AN EXISTING LINE BY THE EXISTING STRUCTURES.

THE EXPANSION IS CONSTRUCTED ALMOST IMMEDIATELY WITH THE ADJACENT EXISTING STRUCTURES. STAFF DOESN'T BELIEVE THE DEVELOPMENT WOULD NEGATIVELY I AM PACK THE PUBLIC OR SURROUNDING PROPERTIES. IN ADDITION, THE ADJACENT PROPERTIES HAVE PROVIDED LETTERS, EXPRESSING NO OBJECTION TO THE EXPANSION ENCROACHMENT. THE STAFF, SUGGEST AS AN INVESTMENT OFFICE WOULD NOT BE DETRIMENTAL TO THE HEALTH, SAFETY OR SURROUNDING NEIGHBORHOOD.

SOME OF THE BIG THINGS I WANT YOU ALL TO THINK ABOUT AND REALLY GETTING BACK WITH ME, FEEDBACK ON IS THE CONCEPT IN THE HISTORIC PRESERVATION AND HOW FAR WE WANT TO TAKE HISTORIC PRESERVATION RULES AND ALSO THE CONCEPT OF A NEIGHBORHOOD CONSERVATION OF A RELAY DISTRICT, THAT WILL BE A PETITION BASED OVERLAY, WHERE THEY WILL CREATE A NEIGHBORHOOD CONSERVATION DISTRICT THAT WOULD PROHIBIT ANY COMMERCIAL ENCROACHMENT INTO THEIR NEIGHBORHOOD.

AND SO BOTH OF CONCEPTS WE CAN TAKE A VERY FAR, BE VERY RESTRICTIVE. WE DON'T HAVE TO ADOPT IT AT ALL OR BABY STEP INTO REGULATING DISTRICTS IN A WAY WE NEVER REGULATED DISTRICTS BEFORE. SO WE HAVE SOME HOMEWORK.
