>> GOOD EVENING, COMMISSIONERS. OUR FIRST ITEM ON THE AGENDA IS A VARIANCE REQUEST AND APPROVAL OF THE FINAL PLAT FOR NORTH HEIGHTS ADDITION RESUBDIVISION NEVER 16.

THE FAMILY TRUST AND CARE OF ALAN WILKINSON IS THE OWNER AND BURGER ENGINEERING LLC IS THE AGENT. THE SUBJECT PROPERTY IS 714 E. RIO GRANDE STREET LEGALLY DESCRIBED AS 1R BLOCK 81 RESUBDIVISION NEVER 16 VICTORIA COUNTY, TEXAS.

THE SUBJECT PROPERTY IS 1.78 ACRE TRACT AND PREVIOUSLY EXISTED AS A COMMERCIAL DEVELOPED OVER MULTIPLE LOTS IN THE SAME BLOCK OF A PLATTED SUBDIVISION.

THE PROPERTY OWNER WISHES TO DEMOLISH THE EXISTING STRUCTURES AND REDEVELOP THE PROPERTY. AS PART OF THE REDEVELOP THE PROPERTY OWNER WISHES TO REFLECT THE PROPERTY TO A SINGLE GENERAL LOT. REQUESTING A VARIANCE TO ALLOW FOR THE APPROVAL OF THE FINAL PLAT DEPICTING AN EXTERIOR SIDE SETBACK OF 8.5 FEET ALONG THE PORTION OF THE NORTHEAST STREET. THE SUBJECT PROPERTY IS BEING REDEVELOPED INTO A SINGLE COMMERCIAL LOT CONTAINED WITHIN ONE WHOLE CITY BLOCK.

THE PROPOSED FINAL REPLANT WILL ESTABLISH A 25 FOOT YARD SETBACK ALONG EAST RIO GRANDE STREET AND 20 FOOT ALONG THE NORTH CAMERON STREET AND EAST OASIS STREET MEETING THE YARD SETBACK REQUIREMENTS. ALONG NORTHEAST STREET THE FINAL REPLANT PROPOSES AN 8.5 EXTERIOR SIDE YARD SETBACK FOR THE CENTER PORTION OF THE PROPERTY ABUTTING NORTHEAST STREET WHILE REMAINING PORTIONS WILL MEET THE MINIMUM REQUIREMENT 20 FOOT EXTERIOR SIDE YARD SETBACK. THE PROPERTY IS BEING REPLANTED INTO A SINGLE GENERAL COMMERCIAL LOT WITHIN A BLOCK 81 LOT 1R THE PROPOSED PLAT WILL DEDICATE 10 FOOT OF IT RIGHT AWAY REQUIRED FOR AN EXPANSION OF ONE PRIMARY ARTERIAL EAST RIO GRANDE STREE . THE PLAT WILL DEDICATE A FIVE FOOT PUBLIC UTILITY EASEMENT ALONG THE NORTH CAMERON STREET, EASTON OASIS STREET. ACCESS TO THE EXCESS OF THE NORTH CAMERON STREET EXISTING LOCAL STREETS. THE FINAL PLAT WILL MEET ALL APPLICABLE ORDINANCES WITH THE APPROVAL OF THE VARIANCE. STAFF RECOMMENDS APPROVAL OF THE VARIANCE REQUEST TO ALLOW FOR THE APPROVAL FOR THE FINAL PLAT DEPICTING A .5 EXTERIOR SIDE YARD SETBACK ALONG THE PORTION OF NORTHEAST STREET BELOW THE MINIMUM REQUIRED SETBACK FOR COMMERCIAL DEVELPMENTS ALONG LOCAL STREETS WHILE MEETING ALL OTHER COMMERCIAL LOT REQUIREMENTS SET OUT IN THE CITY CODE. THE SUBJECT PROPERTY IS BEING DEVELOPED INTO A FAST FOOD RESTAURANT IS KNOWN TO CREATE HIGH VOLUMES OF THE DRIVE THROUGH TRAFFIC. PROTECTING THE SAFETY OF THE PUBLIC THE GRANTING OF THE VARIANCE WOULD ALLOW THE RESTAURANT TO BE CONSTRUCTED IN A WAY IT WOULD ASSIST IN MINIMIZING TRAFFIC BACKING UP ONTO THE PUBLIC ROADWAYS AND KEEP IT ON THE PROPERTY ITSELF.

THE RESTAURANT WILL ADHERE TO THE 20 FOOT EXTERIOR YARD SETBACK ALONG NORTHEAST STREET WHILE ADDRESSING THE CANOPY WILL ADD TO THE 8.5 EXTERIOR YARD SETBACK.

FURTHERMORE, THE CODE ACKNOWLEDGES CANOPIES ARE INHERENTLY DIFFERENT THAN OTHER BUILDING STRUCTURES AS GAS STATION CANOPIES ARE ALLOWED A REDUCED SETBACK OF 12.

THE PROPOSED CONFIGURATION OF THIS CANOPY CONTINUES TO PROVIDE ADEQUATE OPEN SPACE AND SITE TRIANGLE VISIBILITY. STAFF HAS DETERMINED BY KEEPING THE RESTAURANTS TRAFFIC LOW CONTAINED TO THE PROPERTY ITSELF THE GRANTING OF THE VARIANCE WOULD NOT BE DETRIMENTAL TO PUBLIC SAFETY, HEALTH OR WELFARE OR BE INJURIOUS TO THIS READING PROPERTIES. STAFF RECOMMENDS APPROVAL OF THE FINAL PLAT OF THE NORTH HEIGHTS DIVISION RESUBDIVISION 16 UPON FINAL APPROVAL BY CITY COUNCIL.

>> IN THE MONTH OF MARCH DEVELOPMENT SERVICES PROCESSED SIX MINOR PLAT, TO MAJOR PLANTS AND THREE SITE PLANS. ALSO IN THE MONTH OF MARCH WE ISSUED 2 TO 4 PERMITS WHICH WAS AN INCREASE FROM THE PREVIOUS YEAR AS WELL AS 233 COMBINED PERMITS ALSO AN INCREASE FROM LAST YEAR. THE CITY OF VICTORIA ALSO COLLECTED PROXIMALLY $65,000 AND PERMIT FEES ALSO AN INCREASE FROM LAST YEAR.

>> I ALSO HAVE ONE MORE ANNOUNCEMENT FROM STAFF AND A REMINDER THAT NEXT FRIDAY WE WILL HAVE A JOINT MEETING WITH CITY COUNCIL REGARDING THE UNIFIED DEVELOPMENT CODE ORDINANCE. THE CONSULTANT WILL PRESENT THE DYES NEXT TO REPORT.

TOMORROW WE WILL EMAIL YOU THE REPORT SEEN A CHANCE TO READ IT BEFOREHAND AND IT WILL BE AN ONLINE FORM IS SUFFICIENT YOU CAN PROVIDE ANY COMMENTS ON THAT DIAGNOSTIC REPORT BEFORE OUR MEETING NEXT WEEK. THERE'S ALSO GOING TO BE OPENING A CITYWIDE SURVEY THAT WILL ASK CITIZENS A MAPPING EXERCISE THAT WILL ASK PEOPLE TO PUT IN THAT MAP DEVELOPMENTS THEY LIKE AND ONCE THEY DON'T LIKE SO WE CAN TRY TO REPLICATE OR PREVENT THOSE IN THE CODES.
