Variance Request for The Preserve Subdivision - City Plat File 210504 - Southwest of the intersection of Northwest Zac Lentz Parkway and FM 236 - Fergmar Enterprises, LLC (Owner) - Urban Engineering (Agent)

         Variance Request for Section 21-55(c)(2), Intersections, Design Standards, requires proposed new intersections along an existing street to coincide with existing intersections on the opposite side of said street. Proposed new intersections of local streets to existing primary arterial streets shall be spaced a distance of 600 feet.

Variance Request for Smith Subdivision No. 2 - City Plat File 210605 - 3627 Salem Road and 52 Schell Road - David Randall Smith and Susan Smith and Daryl Anthony Smith and Jennifer Smith (Owners) - Balusek-Frankson (Agent)

         Variance Request for Section 21-58(d), Water facilities, requires that in situations within the ETJ where public water is not available within one mile (5,280 feet), the subdivider may either provide a separate water supply and distribution system to serve the entire development, or provide for the use of individual water wells for each lot. Such system(s) shall comply with the requirements of the State Board of Health, shall be constructed in accordance with City specifications, and shall be approved by the Director of Public Works and the City/County Health Department.

         Variance Request for Section 21-59(d), Wastewater facilities, requires that septic tanks and other sewage disposal systems designed to serve individual lots shall be permitted only when the subject property is more than one mile (5,280 feet) from an existing public sanitary sewer main capable of serving the proposed development. In addition, all applicable City, County and State regulations shall be met.

No action or failure of the Planning Commission to act in any proceeding or any statement by any member of the Planning Commission may be relied on by any member of the public to limit the Planning Commission's right to discuss any of the aforementioned subjects in any of its meetings. Any statement specifying inclusion of any word or phrase shall not exclude non-listed items.
