COMMISSION MEETING. JUST A REMINDER TO EVERYONE, TONIGHT'S MEETING IS BEING SIMULTANEOUSLY TELEVISED ON TV 15 IF ANYBODY WOULD LIKE TO WATCH IT IF YOU'RE NOT LISTENING. PUBLIC HEARINGS. OUR FIRST ITEM IS A VARIANCE REQUEST FOR THE PRESERVE SUBDIVISION.

MAY WE HAVE THE STAFF REPORT PLEASE.

>> GOOD EVENING, COMMISSIONERS. SO ON OUR FIRST DEVELOPMENT ITEM TODAY WE HAVE A VARIANCE REQUEST AS WELL AS A PRELIMINARY PLAT AND A FINAL PLAT FOR THE PRESERVED SUBDIVISION.

THIS PROJECT IS LOCATED SOUTHWEST OF THE INTERSECTION AND LOCATED WITHIN THE TMJ. THE OWNER IS SEEKING TO BUILD A PRIVATE DRIVEWAY INTO A PUBLIC ROADWAY INTERSECTION FOR THE PROPOSED LOCAL STREET. THIS INTERSECTION WOULD BE APPROXIMATELY 309 FEET SOUTHWEST OF THE INTERSECTION OF OF FM 236 AND NORTHWEST ZAC LENTZ PARKWAY. THE OWNER IS REQUESTING A REDUCTION OF THE SPACING REQUIREMENT FROM 600 FEET DOWN TO 309 FEET. TXDOT IN ADDITION HAS GRANTED PERMISSION FOR A PRIVATE DRIVEWAY TO BE BUILT INTO A PUBLIC INTERSECTION. CURRENTLY THE PROPERTY IS UNDEVELOPED AND IS BEING PLATTED INTO 23 RURAL RESIDENTIAL LOTS AND A SINGLE COMMERCIAL LOT. ACCESS TO THE SUBDIVISION WILL BE PROVIDED OFF FM 236 NORTHWEST ZAC LENTZ PARKWAY AND A PROPOSED LOCAL STREET. IN ADDITION THE REQUIRED CONSTRUCTION PLANS FOR THE PROPOSED PUBLIC IMPROVEMENTS HAVE BEEN REVIEWED BY THE PUBLIC WORKS DEPARTMENT AND HAVE BEEN APPROVED AT THE TIME OF THIS REPORT.

STAFF RECOMMENDS APPROVAL OF THE VARIANCE REQUEST.

THE DEVELOPMENT OF 23 RURAL RESIDENTIAL LOTS IS NOT A SIGNIFICANT TRIP GENERATOR FOR THE PROPOSED INTERSECTION.

BECAUSE OF AN EXISTING RESIDENTIAL PROPERTY AND A 50-FOOT GAS PIPELINE EASEMENT SOUTH OF THE DEVELOPMENT, A PUBLIC RIGHT OF WAY CANNOT BE DEVELOPED ON THE SOUTHERN END OF THE SUBJECT PROPERTY. STAFF HAS DETERMINED THAT APPROVING THE VARIANCE WOULD NOT BE DETRIMENTAL TO SURROUNDING DEVELOPMENT. STAFF ALSO RECOMMENDS APPROVAL OF THE PRELIMINARY PLAT AND THE FINAL PLAT FOR THE PROPOSED SUBDIVISION. CONDITION ON THE FINAL APPROVAL OF THE REQUESTED VARIANCE BY CITY COUNCIL.

IT ALSO REQUIRES A PUBLIC HEARING, I'D LIKE TO OPEN THE PUBLIC HEARING TO BOTH AGENDA ITEMS WHICH WOULD BE THE VARIANCE AS WELL AS ADOPTION OF THE PRELIMINARY PLAT. IS THERE ANYONE IN THE AUDIENCE THAT WOULD LIKE TO ADDRESS THE COUNCIL ON EITHER OF THOSE AGENDA ITEMS? SEEING NO ONE, I'D LIKE TO CLOSE THE PUBLIC HEARING AT THIS TIME. OUR LAST ITEM IS A VARIANCE REQUEST FOR THE SMITH

SUBDIVISION NO. 2. >> SO NEXT ON THE AGENDA, WE HAVE A VARIANCE REQUEST AS WELL AS APPROVAL OF A FINAL PLAT FOR SMITH SUBDIVISION NO. 2. SO THIS PROJECT IS LOCATED AT 3627 SALEM ROAD AND 52SCHELL ROAD AND IS ALSO LOCATED IN THE ETJ. THE OWNER WISHES TO SUBDIVIDE APPROXIMATELY 0.434 ACRES OF LAND WHICH TRIGGERED THE

PLATTING OF THIS PROPERTY. CURRENTLY THE PROPERTY IS BEING SERVED BY WASTEWATER DISPOSAL SYSTEMS. THEY'RE SEEKING VARIANCES TO CONTINUE USING THEIR ON SITE WASTEWATER WELLS AND DISPOSAL SYSTEMS FOR TWO PLATTED FAMILY LOTS. THE GRANTING OF THESE VARIANCES WOULD ALLOW THESE PROPERTY OWNERS TO CONTINUE USING THESE ON SITE WASTEWATER DISPOSAL SYSTEMS AS THEY ARE CURRENTLY DOING SO WITHOUT HAVING TO EXTEND CITY UTILITIES AS REQUIRED BY THE CITY CODE. THE SMITH SUBDIVISION NO. 2 IS A PROPOSED FINAL PLAT OF TWO ACRES.

IT'S BEING PLATTED INTO TWO SINGLE FAMILY RESIDENTIAL LOTS.

AND IT WILL DEDICATE TWO FEET REQUIRED OF RIGHT OF WAY FOR THE FUTURE EXPANSION OF SCHELL ROAD. ACCESS OF THE SUBDIVISION WILL BE FROM SCHELL ROAD AND SALEM ROAD.

AND IT WILL MEET ALL APPLICABLE ORDINANCES WITH THE APPROVAL OF THE ASSOCIATED VARIANCES. STAFF RECOMMENDS APPROVAL OF THE VARIANCE REQUEST TO ALLOW THE PROPERTY OWNERS TO CONTINUE USING THE ON SITE WATER WELLS AND WASTEWATER DISPOSAL SYSTEMS WHICH HAVE BEEN DEEMED TO BE IN COMPLIANCE WITH THE COUNTY HEALTH DEPARTMENT REQUIREMENTS. THE PROPERTY OWNERS HAVE ALSO SUBMITTED A WELL REPORT. STAFF HAS DETERMINED THAT PROVING THE VARIANCE WOULD NOT SIGNIFICANTLY CHANGE THE EXISTING CHARACTER OF THE AREA AND WOULD NOT BE DETRIMENTAL TO SURROUNDING DEVELOPMENT. FURTHERMORE, DENYING THE VARIANCE AND REQUIRING TWO HOUSES TO BE ON A 4,000 FEET DEAD END LINE WOULD NOT BE BENEFICIAL TO THE PUBLIC HEALTH, SAFETY, AND WELFARE. TWO HOUSES ON THIS DEAD END LINE WOULD NOT NECESSITATE ENOUGH WATER USAGE TO KEEP THE LINE FLUSHED. THERE WERE THE CITY WOULD HAVE TO CONTINUE FLUSHING THE LINE. ADDITIONALLY PLACEMENT OF A SEWER LINE TO THIS PROPERTY WOULD REQUIRE A LIFT STATION.

STAFF ALSO RECOMMENDS APPROVAL OF THE FINAL PLAT SMITH SUBDIVISION NO. 2 CONDITIONED UPON THE FINAL APPROVAL OF THE REQUESTED VARIANCE BY CITY COUNCIL.
